Terms and Conditions

These Terms and Conditions govern the use of the Trust Hub website and the purchase of any trust drafting, will writing, contract drafting and document preparation services supplied by Trust Hub (“we”, “our”, “us”).


By instructing Trust Hub to undertake any work you confirm that you have read, understood and accepted these Terms and Conditions.

1. Initial Consultation


1.1 We offer one complimentary consultation of approximately fifteen (15) minutes.


1.2 The purpose of this consultation is to discuss your circumstances, explain our services and determine whether
we are able to assist.


1.3 The free consultation does not create any contractual obligation on either party.


1.4 No work will commence until we have received:
 the completed Client Information Form;
 all requested supporting information;
 confirmation of instructions; and
 the required initial payment.

2. Client Information


The Client agrees that all information supplied is true, accurate and complete.


The Client is solely responsible for ensuring that:
 names are correctly spelt;
 addresses are accurate;
 dates are correct;
 property details are accurate;
 Land Registry title numbers are correct;
 trustee details are correct;
 beneficiary details are correct;
 all assets intended to be included have been disclosed.


Trust Hub shall not be responsible for inaccuracies arising from incorrect or incomplete information supplied by the
Client.

3. Scope of Services


Depending upon the instructions received, Trust Hub may prepare:

 Trust Indentures;
 Living Trusts;
 Asset Protection Trusts;
 Property Trust Documentation;
 Will Drafting;
 Last Wishes Documentation;
 Private Contracts;
 Bespoke Clauses;
 Terms and Conditions;
 Ancillary Supporting Documents.


Each document is individually drafted according to the Client’s instructions.

4. Fees


Upon acceptance of our quotation:
 fifty percent (50%) of the agreed fee shall become immediately payable before work commences;
 this payment secures your booking and covers administration, consultation, drafting and document
preparation.


The remaining balance becomes payable before final release of the completed documents.

5. Non-Refundable Deposit


The initial 50% payment is:
 non-refundable;
 non-transferable;
 payable in advance;
 required before drafting begins.


Once work has commenced, substantial professional time has been invested in preparing your bespoke
documentation and therefore no refunds shall be given.

6. Final Consultation


Upon completion of the documentation we shall arrange either:
 a Zoom consultation; or
 a telephone consultation.


The purpose of this meeting is to explain the structure and content of the completed documents and answer any
reasonable questions regarding their contents.


Following receipt of the final balance, the completed documentation will be released to the Client.

7. Delivery


Following payment in full, Trust Hub shall provide the completed documentation electronically via email in
downloadable format.


Electronic delivery shall constitute successful completion of the contract.

8. Printed Copies


Should the Client require professionally printed documentation, this service is available at an additional charge.
The additional fee covers:
 professional printing;
 document preparation;
 binding (where applicable);
 secure packaging;
 Royal Mail Special Delivery or equivalent tracked delivery.


Prices will be confirmed prior to dispatch.

9. Corrections
The Client shall have fourteen (14) calendar days from receipt of the completed documentation to review the
contents.


Should the Client identify:
 spelling mistakes;
 typographical errors;
 incorrect names;
 incorrect dates;
 incorrect addresses;
 formatting errors;
 transcription mistakes,


Trust Hub shall correct such errors without additional charge.


Corrections shall normally be completed within forty-eight (48) hours of receiving notification.
Revised documents shall then be re-issued electronically.

10. Amendments


Corrections resulting from Trust Hub’s drafting shall be made without charge.


Requests involving:
 additional clauses;
 additional beneficiaries;
 additional trustees;

 further assets;
 changes to instructions;
 alterations after approval,
may be treated as additional work and charged separately.

11. Land Registry Documentation


Where property is involved, Trust Hub may provide the appropriate HM Land Registry forms including (where
applicable):
 AP1;
 TR1;
 RX1.


General written guidance explaining how to complete these forms will be supplied free of charge.


The Client remains responsible for completing, signing and submitting these forms unless otherwise instructed.

12. Land Registry Submission Service


If requested, Trust Hub can prepare and complete the Land Registry application on the Client’s behalf.
The fee for this service is £350.00 per application unless otherwise agreed in writing.


Any HM Land Registry fees, Identity Verification fees or third-party charges remain payable by the Client.

13. No Refund Policy


Due to the bespoke and personalised nature of our work:

 no refunds shall be provided after work has commenced;
 no refunds shall be provided after documentation has been completed;
 no refunds shall be provided once electronic delivery has taken place.


Nothing within this clause affects any statutory rights that cannot legally be excluded.

14. Client Responsibilities


The Client agrees to:
 provide complete information;
 respond promptly to requests;
 review draft documentation carefully;
 ensure all instructions are accurate before approval;
 obtain independent legal, tax or financial advice where appropriate.

15. Limitation of Service


Trust Hub prepares documentation based solely upon the instructions provided by the Client.


We do not guarantee:
 court acceptance;
 tax treatment;
 creditor protection;
 future legal outcomes;
 decisions made by public authorities or third parties.


The Client remains responsible for obtaining independent professional advice where necessary for their particular
circumstances.

16. Intellectual Property


All documentation produced by Trust Hub remains our intellectual property until payment has been received in full.


Upon payment, the Client receives a licence to use the completed documentation for their own personal or
business purposes as instructed.


Our templates, drafting methods, wording and intellectual property may not be reproduced, copied, distributed or
sold without our written consent.

17. Confidentiality


Trust Hub treats all client information as confidential.


Information will only be disclosed where:
 required by law;
 authorised by the Client; or
 necessary to perform the agreed services.

18. Data Protection


Trust Hub processes personal information in accordance with applicable UK data protection legislation, including
the UK GDPR and the Data Protection Act 2018.

​

19. Governing Law


These Terms and Conditions shall be governed by the laws of England and Wales.


Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and
Wales.

20. Acceptance


By instructing Trust Hub and making payment of the initial fee, the Client confirms that they:
 have read these Terms and Conditions;
 understand them;
 agree to be legally bound by them.
